DAVID J. BRODERICK - In the News

CITY SUED OVER AIDS "TATTLETALE"
New York Post
by William Neuman

A Queens woman is suing the city for $50 million, charging she was tormented by a welfare-agency temp worker who sneaked a peek at her private case file and then told her neighbors she was HIV-positive.
The 38-year-old single mother, whose name is not disclosed in the lawsuit, charges that Human Resources Administration temp worker Beverly Gibson called her at home in March 2003, and said "she had accessed [her] file and knew [her] to be HIV positive," according to papers filed this week in Manhattan federal court.

The suit, which seeks $50 million in damages, says Gibson, 37, who lived a few blocks from the woman in Richmond Hill, then told other people in their neighborhood she had the AIDS virus.

The woman's lawyer, David Broderick, said the harassment began after the woman left Gibson a phone message attempting to collect a small-claims judgment she had won against the HRA worker.

Gibson then left a threatening message on the woman's voice mail, saying she'd looked up her HRA file, the woman told The Post.

The suit says Gibson then told people in their neighborhood that the woman had the AIDS virus.

Gibson could not be reached for comment.
